The HSE, also known as The Health and Safety Executive, is one of the most efficient quasi-autonomous non-governmental organizations in the UK and is responsible for proposing and enforcement of regulations that aim at overall health safety and welfare of employees at workplaces. This organization takes into account adverse workplace conditions within England, Wales and Scotland. The Health and Safety at Work etc. Act 1974, played the most important part behind creation of this body of governance and also functions as the strongest foundation when it comes to legal empowerment of this institution. Steps that HSE Follow to Ensure Health and Safety at Workplace:

 

While a prime role of the HSE is to come up with propositions that may improve the existing employment law in the UK and the rights that employees are eligible to receive, this body has also the legal capacity to enforce provisions that may secure issues related to health and safety of workers. Steps of the procedure comprise

 

  • Inspection and investigation of the situation
  • Receiving complaints from employees
  • Proposing enforcement of the health and safety measures
  • Giving notice about the final date for implementing the measures
  • Prosecuting the employee for not adhering to the propositions
  • Taking into account issues like penalties and major incidents that occurred before due to employer’s negligence

 

In order to enforce these procedures, the HSE operates together with other local authorities that are assigned with the responsibility to supervise the condition of health and safety issue of workers. In addition, the Enforcement Management Model provides these authorities with a correct framework, according to which the necessary formalities need to be fulfilled.

 

Criteria that Employers Are Responsible to Fulfill towards Employees under the HSE law:

 

  • Involvement in regular risk assessment, which would help them to understand the potentially harmful risk factors for employees health
  • Arranging training sessions to demonstrate employees about the best methods to control risks and staying safe
  • Make necessary changes in the management so that maximum security can be provided to employees at the workplace
  • Deliver employees with the necessary equipments, without any extra charge so that they can safety work in the workplace
  • Keep sufficient first-aid facilities handy
  • In case of any accident, they should be immediately informing the HSE Incident Contact Centre

 

The HSE law celebrates the jurisprudential approach that every worker has complete right to enjoy a work environment that may provide them with complete protection to health and safety issues. It also clearly states that though employers are responsible and should attempt their best to keep workers from harm’s way, employees should also act responsibly and assist the HSE in order to accomplish the objective successfully.
